Terms of service
SHIFAH® TERMS OF SERVICE
This website is operated by SHIFAH®, a trading name of SHIFAH Global Ltd.
Throughout this website, the terms “SHIFAH®”, “we”, “us” and “our” refer to SHIFAH Global Ltd trading as SHIFAH®.
These Terms of Service (“Terms”) govern your access to and use of shifah.co, including purchases made through our website.
Our store uses Shopify’s ecommerce platform to enable us to offer and sell products to customers.
Please read these Terms carefully before using our website or placing an order.
By accessing our website, creating an account or purchasing from us, you agree to these Terms together with the policies referenced in them, including our Refund, Returns, Cancellation & Subscription Policy and Privacy Policy.
Nothing in these Terms excludes, restricts or overrides any mandatory rights available to consumers under applicable law.
SECTION 1 — ONLINE STORE TERMS
You must have legal capacity to enter into a contract with us when making a purchase.
You must not use our website, products or services for any unlawful or unauthorised purpose.
You must not:
Introduce viruses, malware or other malicious code;
Attempt unauthorised access to our website or systems;
Interfere with the operation or security of our website;
Use our website fraudulently;
Submit knowingly false or misleading information; or
Use our website in violation of applicable law.
We may restrict or terminate access where reasonably necessary in response to fraud, misuse, security threats or material breaches of these Terms.
SECTION 2 — ORDERS & FORMATION OF CONTRACT
Submitting an order does not necessarily mean that we have accepted it.
An order is accepted when we confirm acceptance or dispatch the goods, depending on the checkout and fulfilment process applicable to your order.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
A product is unavailable;
There is an obvious pricing or listing error;
Payment cannot be authorised;
Fraud or unauthorised activity is reasonably suspected;
Order quantities indicate unauthorised commercial resale;
Delivery cannot reasonably be completed to the address supplied;
The transaction breaches applicable law; or
We are otherwise legally entitled to refuse the transaction.
Where we cancel an order after payment and no goods are supplied, any amount due back to you will be refunded in accordance with applicable law.
SECTION 3 — CUSTOMER INFORMATION
You agree to provide current, complete and accurate information when placing an order.
This includes your:
Name;
Billing information;
Delivery address;
Email address; and
Other information reasonably necessary to process the transaction.
You are responsible for checking your order and delivery information before completing checkout.
If you discover an error after placing an order, contact us promptly.
Because orders may be processed quickly, we cannot guarantee that information can be amended once fulfilment has begun.
SECTION 4 — PRODUCTS
We take reasonable care to describe and display our products accurately.
Product images are provided for illustrative purposes. Colours, appearance and packaging may vary slightly depending on screen settings, manufacturing updates, packaging changes or legitimate brand transitions.
Nothing in these Terms excludes your statutory rights that goods must meet applicable legal standards, including being as described, of satisfactory quality and fit for applicable purposes.
SECTION 5 — SHIFAH® / SXC GLO REBRAND
SHIFAH® has transitioned from the previous SXC Glo branding.
During the transition, legitimate stock may display previous SXC Glo packaging or current SHIFAH® packaging where applicable.
Where a packaging variation is disclosed, the fact that packaging differs from an image or carries previous legitimate branding does not, by itself, mean that the product is faulty or inauthentic.
Your statutory rights concerning the actual goods remain unaffected.
SECTION 6 — PRICES
Product prices are displayed on our website.
We may change prices for future purchases at any time.
A price change will not retrospectively alter the agreed price of an order that we have already accepted, except where permitted by law or where there has been an obvious pricing error that is addressed before a binding contract is formed.
Where applicable, taxes and delivery charges will be displayed or calculated during checkout.
SECTION 7 — PROMOTIONS, DISCOUNTS & OFFERS
Promotional offers are subject to the specific terms displayed with the promotion.
Unless expressly stated otherwise:
Promotional codes cannot be combined;
Promotions do not apply retrospectively to previous purchases;
Gift cards may be excluded;
Minimum-spend or product eligibility requirements may apply;
Promotions may be limited by date, stock or availability.
SHIFAH® may amend, withdraw or extend a promotion for future purchases where reasonably necessary.
Any order already accepted remains subject to the terms applicable when the order was made.
Statutory consumer rights are not removed because a product was purchased using a discount or promotion.
SECTION 8 — SALE, CLEARANCE & REBRAND STOCK
Sale, clearance, promotional, multipack and rebrand goods remain subject to applicable statutory consumer rights.
Where a specific issue, characteristic or packaging variation was clearly disclosed before purchase and formed part of the offer, that disclosed characteristic will not, by itself, constitute a product fault.
Returns and refunds are governed by our Refund, Returns, Cancellation & Subscription Policy.
SECTION 9 — SUBSCRIBE & SAVE
Certain SHIFAH® products may be offered as:
ONE-TIME PURCHASE
or
SUBSCRIBE & SAVE
These are separate purchasing options.
Subscribe & Save is a recurring subscription.
Before completing a subscription purchase, the applicable recurring nature, price, discount and delivery/renewal frequency will be displayed as part of the subscription offer.
By selecting Subscribe & Save and completing checkout, you authorise recurring payments for the selected products at the disclosed frequency until the subscription is cancelled.
SECTION 10 — MANAGING & CANCELLING SUBSCRIPTIONS
SHIFAH® subscriptions are self-managed online.
Customers do not need to contact Customer Service to cancel their subscription.
Available account functions may include:
Viewing the subscription;
Pausing it;
Skipping an upcoming delivery;
Managing products;
Updating eligible information; and
Cancelling the subscription.
To prevent a future scheduled renewal, cancellation should be completed through the subscription management facility before the relevant recurring payment is processed.
If you experience a technical problem preventing cancellation, contact us promptly by email so that we can investigate.
Customer support is provided by email.
SHIFAH® does not operate telephone customer service or telephone subscription cancellation.
SECTION 11 — SUBSCRIPTION RENEWALS ALREADY PROCESSED
Cancelling a subscription and cancelling an individual order already generated are different actions.
Cancelling your subscription stops future renewals.
If a recurring payment has already been processed and the resulting order generated before cancellation is completed, subsequent cancellation does not automatically reverse that payment or recall the order.
If you also wish to request interception of an already-generated renewal order, contact us promptly by email.
We will attempt to stop the shipment where reasonably possible but cannot guarantee interception once processing, packing, courier collection or dispatch has begun.
Any applicable statutory cancellation or return rights remain unaffected.
Full subscription, cancellation and refund provisions are contained in our Refund, Returns, Cancellation & Subscription Policy.
SECTION 12 — RETURNS, REFUNDS & CANCELLATIONS
Our Refund, Returns, Cancellation & Subscription Policy forms part of these Terms and governs:
Change-of-mind cancellations;
Health and hygiene products;
Returns;
Faulty goods;
Damaged or incorrect orders;
Return postage;
Order cancellation;
Subscription cancellation;
Missing parcels;
International returns;
Refunds; and
Related matters.
Nothing in that policy or these Terms limits any mandatory statutory consumer right.
SECTION 13 — COSMETICS, PRODUCT USE & INDIVIDUAL RESULTS
SHIFAH® sells cosmetic and personal-care products.
Products should be used in accordance with the instructions and warnings supplied with them.
Where patch testing is recommended, customers should follow those instructions before wider use.
Individual skin and hair can respond differently to cosmetic products.
We do not guarantee that every product will produce identical or particular cosmetic results for every individual.
An individual preference, sensitivity, reaction or failure to achieve a desired cosmetic result does not, by itself, establish that the product is defective.
Nothing in this section excludes or restricts liability or statutory remedies where a product is genuinely faulty, unsafe, not as described or otherwise does not conform to applicable legal requirements.
SECTION 14 — INTERNATIONAL ORDERS
Orders delivered outside the United Kingdom may be subject to customs procedures, import requirements, taxes, duties and charges imposed by the destination country.
Unless expressly stated otherwise, these third-party charges are the responsibility of the recipient.
Customers are responsible for checking whether products can lawfully be imported into their destination country before ordering.
SHIFAH® does not control customs authorities and cannot guarantee customs-processing times.
Customs duties, import taxes and charges collected by governments, carriers or other third parties are not payments made to SHIFAH® and cannot be refunded by us.
Where an order is returned because:
Import charges were refused;
Customs requirements were not completed;
Delivery was refused;
The parcel was not collected; or
The delivery information supplied by the customer was incorrect,
the appropriate resolution will be determined once the parcel has safely returned to us, subject to applicable law and our Refund, Returns, Cancellation & Subscription Policy.
Where a product is confiscated or restricted by a destination authority, the outcome will depend on the circumstances, applicable law and responsibility for compliance with the relevant import requirements.
We do not exclude responsibility where SHIFAH® is legally responsible.
SECTION 15 — DELIVERY
Delivery estimates are estimates unless expressly guaranteed.
Delivery may occasionally be affected by events outside our reasonable control, including courier disruption, customs processing, weather, transport disruption or other external events.
Customers are responsible for providing a complete and accurate delivery address and for taking reasonable steps to receive or collect their parcel.
Delivery disputes, missing parcels, returned-to-sender orders and denial-of-receipt claims are governed by our Refund, Returns, Cancellation & Subscription Policy.
Nothing in this section limits rights that cannot legally be excluded.
SECTION 16 — ACCOUNTS, FRAUD & ORDER LIMITS
We may reasonably restrict order quantities or refuse transactions where necessary to:
Prevent fraud;
Protect customers;
Protect SHIFAH®;
Comply with legal obligations;
Prevent unauthorised commercial resale; or
Protect the integrity of our services.
Restrictions may take into account legitimate fraud-prevention indicators including multiple orders associated with the same account, payment method, billing address or delivery address.
We may suspend an account or refuse future transactions where reasonably justified by suspected fraud, abuse or material breach of these Terms.
We will not treat the legitimate exercise of statutory consumer rights as fraud or abuse.
SECTION 17 — CHARGEBACKS & PAYMENT DISPUTES
If you believe there is a problem with an order, subscription, payment or delivery, we encourage you to contact SHIFAH® promptly so that we can investigate.
Where a chargeback or payment dispute is raised, we may provide relevant evidence to payment processors, acquiring banks, card issuers and card networks.
Evidence may include:
Order and payment records;
Subscription enrolment and renewal records;
Subscription status and cancellation history;
Customer account activity;
Communications;
Fulfilment records;
Tracking and proof of delivery;
Customer-facing subscription disclosures; and
Relevant fraud-prevention information where lawfully processed.
We reserve the right to contest payment disputes where our records indicate that a transaction was valid, authorised or fulfilled, a subscription remained active, cancellation did not occur as alleged, or the dispute is otherwise inconsistent with our records.
Nothing in this section restricts a customer’s legitimate right to raise a payment dispute or exercise statutory consumer rights.
SECTION 18 — THIRD-PARTY SERVICES & TOOLS
Our website may use or provide access to third-party services, applications, payment systems, subscription tools or links.
We are not responsible for independent third-party websites or services outside our control.
Where you choose to use an independent third-party service, its own terms and privacy practices may apply.
Nothing in this section excludes responsibility that SHIFAH® cannot lawfully exclude.
SECTION 19 — INTELLECTUAL PROPERTY
Unless otherwise stated, content made available through shifah.co, including branding, text, graphics, logos, product imagery, website content and other materials owned by SHIFAH Global Ltd is protected by applicable intellectual-property law.
SHIFAH® is a protected brand/trademark.
You must not reproduce, commercially exploit, distribute, copy or use our protected materials without permission except where permitted by law.
SECTION 20 — USER CONTENT, REVIEWS & SUBMISSIONS
Where you submit reviews, comments, photographs, testimonials or other content to us, you confirm that you have the right to submit that material.
Your content must not:
Infringe another person’s intellectual-property or privacy rights;
Be knowingly false or misleading;
Contain unlawful, defamatory, threatening or abusive material;
Contain malicious code; or
Otherwise violate applicable law.
We may moderate or remove content where reasonably necessary to comply with law, platform requirements or these Terms.
Any use by SHIFAH® of customer-created content will be subject to applicable intellectual-property, privacy and consumer-protection requirements.
SECTION 21 — PERSONAL INFORMATION
Personal information is processed in accordance with our Privacy Policy and applicable data-protection law.
Where necessary and lawful, relevant information may be processed or shared for purposes including:
Order fulfilment;
Payment processing;
Subscription management;
Delivery;
Fraud prevention;
Customer support;
Legal compliance; and
Establishing, exercising or defending legal claims.
SECTION 22 — WEBSITE ACCURACY & ERRORS
We take reasonable steps to maintain accurate information.
Occasionally the website may contain typographical errors, inaccuracies or omissions relating to descriptions, prices, promotions, availability, delivery information or other content.
Where legally permitted, we may correct an error when identified.
We will not retrospectively alter an accepted consumer contract merely because we later decide to change a product price or term.
Nothing in this section limits statutory rights relating to misleading information or goods that are not as described.
SECTION 23 — PROHIBITED USE
You must not use our website:
For unlawful purposes;
To commit or facilitate fraud;
To submit knowingly false information;
To infringe intellectual-property rights;
To harass or unlawfully discriminate against others;
To distribute malware;
To scrape or harvest information unlawfully;
To interfere with website security;
To gain unauthorised access to systems; or
In any manner prohibited by applicable law.
We may restrict access where reasonably necessary to protect SHIFAH®, customers or third parties.
SECTION 24 — WEBSITE AVAILABILITY
We aim to keep our website and services available but cannot guarantee uninterrupted or error-free access.
We may temporarily suspend or modify website functionality for maintenance, security, technical or operational reasons.
We will exercise our rights under this section reasonably and nothing in it affects an accepted order or consumer right that cannot lawfully be restricted.
SECTION 25 — LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing excludes or restricts liability for:
Death or personal injury caused by negligence;
Fraud or fraudulent misrepresentation;
Breach of mandatory statutory consumer rights; or
Any other liability that cannot legally be excluded or limited.
For consumers, SHIFAH® is responsible for losses that are a foreseeable consequence of our breach of contract or failure to exercise reasonable care and skill, subject to applicable law.
We are not responsible for losses that are not a foreseeable consequence of our breach or that arise from circumstances for which we are not legally responsible.
Products purchased as a consumer are supplied for personal and domestic use unless otherwise agreed.
Nothing in this section affects your statutory rights.
SECTION 26 — INDEMNITY
Where you use our website in a business capacity, you are responsible for losses reasonably arising from your unlawful use of the website or material breach of these Terms, subject to applicable law.
Nothing in this section requires a consumer to indemnify SHIFAH® in circumstances where doing so would be unfair or unlawful.
SECTION 27 — TERMINATION & SUSPENSION
You may stop using our website at any time.
We may suspend or terminate access where reasonably necessary because of:
Fraud or suspected fraud;
Security threats;
Unlawful activity;
Material breach of these Terms; or
Other serious grounds reasonably requiring restriction.
Termination of website access does not affect rights or obligations that arose before termination.
SECTION 28 — SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will apply only to the maximum extent legally permitted and, where necessary, will be treated as severed.
The remaining provisions will continue to apply.
SECTION 29 — NO WAIVER
If we do not immediately enforce a right available to us under these Terms, that does not necessarily mean that we have waived that right.
A waiver on one occasion does not automatically constitute a waiver on another occasion.
SECTION 30 — ENTIRE AGREEMENT
These Terms, together with the policies expressly incorporated into them, constitute the agreement governing your use of our website and purchases from us, subject to any other terms expressly agreed between us and any rights arising under applicable law.
SECTION 31 — GOVERNING LAW
These Terms are governed by the laws of England and Wales.
If you are a consumer, nothing in these Terms deprives you of any mandatory protections or rights relating to jurisdiction that apply to you under applicable law.
SECTION 32 — CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, services, technology or legal obligations.
The version applicable to a particular transaction will not be retrospectively changed merely because we subsequently update these Terms.
The current version and its effective date will be displayed on this page.
We recommend retaining your order confirmation and any terms supplied to you in connection with your transaction.
